Terms and Conditions

The rules for using RUC Pass.

These Terms and Conditions (“Terms”) govern your access to and use of the RUC Pass website at https://www.rucpass.co.nz (the “Site”) and the RUC Pass mobile application (the “App”), together the “Services”.

The Services are operated by RUC ON RAILS LIMITED. RUC Pass is a product and brand of RUC ON RAILS LIMITED and is not a separate legal entity.

By accessing or using the Services, or by creating a RUC Pass account, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Operator and legal identity

1.1 The Site is owned and operated by RUC ON RAILS LIMITED, a company incorporated in New Zealand.

1.2 Any reference to “RUC Pass”, “we”, “us”, or “our” refers to RUC ON RAILS LIMITED in its capacity as operator of the Site.

2. What the Services are (and are not)

2.1 The Site provides general product information about RUC Pass, including features, availability information, and updates.

2.2 The App lets you create an account, add vehicles by registration plate, view vehicle details sourced from the New Zealand Transport Agency (NZTA) Motor Vehicle Register, and record odometer readings. Additional features may be added over time.

2.3 The App does not currently process payments or sell Road User Charges (RUC). Where payment functionality becomes available, additional terms may apply.

2.4 Nothing on the Services constitutes legal advice, financial advice, tax advice, compliance advice, or official government guidance.

2.5 Any reliance on information obtained through the Services is at your own risk.

3. Accounts and communications

3.1 To use the App, you create an account using a valid email address and password. You must keep your credentials confidential and are responsible for activity that occurs under your account.

3.2 You must provide accurate information when registering or when adding vehicles or other details, and you must keep that information up to date.

3.3 You may close your account at any time from within the App (Profile -> Delete Account) or by contacting support@rucpass.co.nz. Account closure may take effect after a short grace period during which the closure can be reversed on request.

3.4 By creating an account or submitting your email through the Site, you consent to receiving service-related communications (for example: security or operational notices, account changes, product changes). You may opt out of non-essential marketing communications at any time.

3.5 We do not guarantee any specific launch date, availability, geographic coverage, pricing, or feature set. Plans can change.

4. Future services and changes

4.1 We intend to develop and expand RUC Pass over time. Features described on the Site may be amended, delayed, discontinued, or replaced.

4.2 If and when transaction functionality becomes available, additional terms may apply (including terms covering payments, fees, refunds, and service rules). Those terms will be posted on the Site and may be incorporated into these Terms.

5. Third-party services and links

5.1 The Services may link to or rely on third-party websites, tools, services, or data providers (for example the NZTA Motor Vehicle Register for plate lookups). These are not under our control.

5.2 We do not endorse, guarantee, or accept responsibility for third-party content, services, availability, accuracy, or performance.

6. Acceptable use

6.1 You must not misuse the Services, attempt unauthorised access, interfere with operation, introduce malware, or use the Services in a way that is unlawful or harmful.

6.2 You must not scrape, harvest, or crawl the Services at scale, or use automated systems to access them in a manner that imposes an unreasonable load, without our written permission.

6.3 You must not use the Services to look up or monitor vehicles in which you have no legitimate interest, or to harass any person.

6.4 We may block, rate-limit, suspend, or restrict access to the Services at our discretion.

7. Intellectual property

7.1 Except where otherwise stated, all intellectual property rights in the Services and their content (including text, branding, logos, design elements, and layout) are owned by RUC ON RAILS LIMITED or its licensors.

7.2 You may view the Site, install and use the App on devices you own or control, and share links to the Site. You must not reproduce, distribute, reverse engineer, or commercially exploit substantial portions of the Services without our prior written consent.

8. Privacy

8.1 We collect, use, store, and disclose personal information in accordance with the Privacy Act 2020 (New Zealand) and our Privacy Policy.

8.2 The Privacy Policy forms part of these Terms and is available at /privacy.

9. Disclaimers and limitation of liability

9.1 To the maximum extent permitted by New Zealand law, we exclude all liability for loss or damage arising from or in connection with your use of the Site, including loss arising from:

  • reliance on information on the Site
  • Site availability, downtime, or errors
  • third-party links or services
  • any delay or change to product availability or features

9.2 Where liability cannot be excluded, our total aggregate liability to you, whether in contract, tort (including negligence), equity, statute, or otherwise, is limited to the greater of:

  • NZD $1,000; or
  • the maximum amount permitted by law.

10. Indemnity

You agree to indemnify and hold harmless RUC Pass and RUC ON RAILS LIMITED from any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising from your breach of these Terms, misuse of the Site, or infringement of third-party rights.

11. Changes to these Terms

11.1 We may update these Terms at any time by publishing the updated version on the Site.

11.2 Your continued use of the Site after changes are published constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts.
